What Data We Collect

MaxLend collects information you provide to us:

When you apply for a loan:

Your name, address, phone number, Social Security number, driver’s license or passport, income, employment history, and financial account information.

Identity Verification:

In certain situations, MaxLend may require additional identity verification through a third-party service provider secure portal. When requested, you will be directed to the third-party service provider to complete identity verification. This third-party service provider collects and stores facial biometrics and government ID images directly; MaxLend does not directly store or collect this biometric information. Third-party service provider returns only a verification confirmation to MaxLend. Your biometric data is maintained solely by third-party service provider under their privacy practices.

We may collect information from credit bureaus and other service providers we work with to verify your information and assess your creditworthiness.

Who Sees Your Data

Our affiliate companies

MaxLend shares your information with other lending companies that are part of the Mandan, Hidatsa, and Arikara Nation’s business family. These companies may use your information to service your loan, conduct everyday business operations, assess your creditworthiness, and offer you products and services. You can opt out of marketing from affiliate companies at any time.

Service providers (Vendors we hire)

MaxLend works with companies to help us process payments, verify your information, prevent fraud, and provide customer service. These companies can only use your information to help us and cannot use it for their own marketing. Examples include payment processors, background check companies, and IT support vendors.

Credit bureaus

We report your payment history to credit bureaus to help build your credit score.

When required by law

We may share your information to comply with legal, regulatory or contractual requirements.

Plain Language Definitions

Affiliates:

Other lending businesses owned and controlled by the Mandan, Hidatsa, and Arikara Nation. They are like sister companies under the same tribal ownership.

Nonaffiliates:

Other companies that are not owned and controlled by the Mandan, Hidatsa, and Arikara Nation.

Service providers (Vendors):

Companies we hire to help us run our business. For example: banks that process our payments, companies that verify your employment, IT support firms, and mail providers. They can only use your information to help us.

De-identified data:

Information that has your name, Social Security number, account number, and other identifying details removed so no one can connect it back to you. Service providers can use de-identified data for their own business purposes (like analyzing trends), but they cannot use it to target you for marketing.

Personal Information:

Any information that identifies you, like your name, address, phone number, Social Security number, income, bank account details, or loan information.

Biometric Information:

Personal information is based on a person’s unique physical or behavioral characteristics that can be used to identify them, such as a fingerprint, face scan, voiceprint, or eye scan.

Tribal Sovereignty

MaxLend is a sovereign enterprise of the Mandan, Hidatsa, and Arikara Nation. Your loan is made by a sovereign government, and MaxLend’s dispute resolution forums are limited to those available under tribal law. By borrowing from MaxLend, you consent to tribal jurisdiction and agree that disputes will be resolved through tribal dispute resolution or arbitration before a neutral arbitrator, not through state or federal courts. MaxLend and the Tribe have not waived sovereign immunity.

MaxLend, is a sovereign enterprise, an economic development arm and instrumentality of, and wholly-owned and controlled by, the Mandan, Hidatsa, and Arikara Nation, a federally-recognized sovereign American Indian Tribe. (the “Tribe”). This means that MaxLend’s loan products are provided by a sovereign government and the proceeds of our business fund governmental services for Tribe citizens. This also means that MaxLend is not subject to suit or service of process. Rather, MaxLend is regulated by the Tribe. If you do business with MaxLend, your potential forums for dispute resolution will be limited to those available under Tribal law and your loan agreement. As more specifically set forth in MaxLend’s contracts, these forums include an informal but affordable and efficient Tribal dispute resolution, or individual arbitration before a neutral arbitrator. Otherwise, MaxLend is not subject to suit or service of process. Neither MaxLend nor the Tribe has waived its sovereign immunity in connection with any claims relative to use of this website. If you are not comfortable doing business with sovereign instrumentality that cannot be sued in court, you should discontinue use of this website.
